These Terms of Use apply to your use of the Fused Glass Studio mobile application and the My Fused Glass Studio website.
By using the app or website, you agree to these Terms of Use. If you do not agree with them, please do not use the app or website.
Fused Glass Studio is a tool designed to help users organise and record their fused glass projects.
The app provides features for recording project information, materials, glass products and colours, photographs, firing information, schedules and other studio notes.
The app is intended as an organisational and record-keeping tool. It is not a substitute for the instructions, technical information or safety guidance provided by glass, kiln or equipment manufacturers.
Fused Glass Studio is designed to store your project information on your device and, where iCloud synchronisation is enabled and available, to synchronise supported project information between your devices using Apple’s iCloud services and the iCloud account associated with your device.
Your project information may include project descriptions, notes, glass and material selections, firing information, schedules, photographs, layer reference images and other information that you enter into the app.
Photographs added to your projects are stored as part of the app’s local data and, where supported by the app’s synchronisation features, may be synchronised between your devices through Apple’s iCloud services.
The app includes an optional background-removal feature that uses Apple’s Vision and Core Image frameworks to process photographs within the app. This processing does not require photographs to be uploaded to a separate background-removal service.
My Fused Glass Studio does not operate its own cloud storage service for your project database or photographs. We do not ordinarily have direct access to the contents of your private iCloud database. Apple handles iCloud data in accordance with its applicable terms and privacy policies.
iCloud synchronisation depends on factors including your iCloud account, device settings, available storage, network connectivity and the operation of Apple’s services. Synchronisation may be delayed or may not complete successfully in some circumstances. We do not guarantee uninterrupted or error-free synchronisation.
You are responsible for maintaining appropriate backups of important project information and photographs. Do not rely on synchronisation as your only means of protecting valuable information. Changes or deletions may be reflected across synchronised devices, and information may be lost if it is deleted or becomes unavailable.
My Fused Glass Studio cannot recover project information or photographs that are permanently lost from your devices or iCloud account and to which we have no access.
Your use of iCloud is also subject to Apple’s applicable terms and conditions and privacy policies. For further information about how Apple handles personal information, please consult Apple’s Privacy Policy.
Firing schedules provided within Fused Glass Studio are intended as starting points and general reference information only.
Firing results can vary depending on factors including:
A firing schedule that works successfully in one kiln or for one project may not produce the same result in another.
Always follow the current technical guidance provided by the relevant glass manufacturer and kiln manufacturer.
When using an unfamiliar schedule, we recommend testing it with a sample piece before firing an important project.
Fused Glass Studio does not guarantee that any particular firing schedule will produce a particular result.
You are responsible for ensuring that the glass and other materials you use are compatible and appropriate for your project.
You should follow the manufacturer’s instructions and safety guidance for all glass, kilns, tools, chemicals and other materials used in your studio.
Fused Glass Studio does not determine whether particular materials are compatible or safe to use together.
The app may provide image-processing features, including background removal.
These features are provided as tools to assist with organising your project photographs. Results may vary depending on the photograph and the subject.
You are responsible for reviewing the resulting image before using or relying on it.
We aim to provide useful and accurate information within the app and on the website.
However, information may occasionally contain errors, omissions or outdated material. Product ranges, colours, specifications and manufacturer guidance may change.
Information provided by the app should therefore be checked against the current information supplied by the relevant manufacturer where appropriate.
The Fused Glass Studio app, My Fused Glass Studio website, their designs, branding, text, graphics, software and other original content are owned by or licensed to My Fused Glass Studio, unless otherwise stated.
You may use the app for your own personal or studio-related purposes.
You must not copy, reproduce, modify, distribute, sell, reverse engineer or commercially exploit the app or its original content except where permitted by law or with our written permission.
This does not affect your ownership of photographs, project information or other material that you create and enter into the app.
The app may refer to glass manufacturers, products, colours and other third-party brands for identification and organisational purposes.
Such names and trademarks remain the property of their respective owners.
My Fused Glass Studio is independent of those manufacturers unless expressly stated otherwise.
We aim to keep the app and website available and functioning properly, but we do not guarantee that they will always be available or free from errors.
The app or website may occasionally be unavailable because of maintenance, updates, technical problems or circumstances beyond our reasonable control.
We may update, modify or discontinue features of the app or website from time to time.
We may release updates to Fused Glass Studio to add features, improve performance, fix problems or maintain compatibility with Apple’s operating systems.
You should keep the app and your device’s operating system reasonably up to date.
Fused Glass Studio is provided as an organisational and record-keeping tool. It is not a substitute for professional advice, manufacturer instructions, technical specifications or appropriate safety procedures.
To the extent permitted by applicable law, we are not responsible for losses arising from reliance on information or firing schedules provided by the app, unsuccessful firings, or damage to glass or equipment. We cannot guarantee against the loss of project information or photographs stored on your device or synchronised through Apple’s iCloud services. Nothing in this section excludes or limits our responsibility where the law does not permit such exclusion or limitation.
You remain responsible for checking the suitability of materials and firing schedules, following relevant manufacturer instructions, and maintaining your own backups of important project information.
Nothing in these Terms excludes or limits liability, statutory rights or consumer protections that cannot legally be excluded or limited.
You are responsible for using the app appropriately and for making your own decisions about your projects, materials, firing schedules and studio practices.
In particular, you should always follow appropriate safety procedures and the current instructions supplied by manufacturers.
If you contact us through the website or by email, you agree to provide information that is accurate to the best of your knowledge.
Information submitted through the contact form is handled in accordance with our Privacy Policy.
We may update these Terms of Use from time to time to reflect changes to the app, website or applicable requirements.
The latest version will be published on this page with the date of the latest update.
Where a change materially affects your rights or obligations, we will take reasonable steps to bring it to your attention. Changes will apply from the date stated in the updated Terms, subject to applicable law. If you do not agree with a change, you may stop using the app or website. Nothing in this section affects any rights you have under applicable law.
These Terms of Use are governed by French law.
If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory consumer protection laws that apply in your country of habitual residence.
Nothing in these Terms excludes or restricts any rights or remedies that cannot lawfully be excluded or restricted under applicable law.
